Corporate Gifts Terms and Conditions and General Trading Information
Introduction
The terms and conditions herein apply to all orders and supersede all others. Orders received by Boomerang from you also constitutes your acceptance that our conditions are the only conditions that apply to the contract notwithstanding any purported terms put forward by you.
Payment
Increasing levels of fraud and deception has meant that all goods will be supplied against a Proforma invoice except in exceptional cases where a credit account may be approved.
Boomerang may approve and open a credit account for you providing that you have spent no less than £5000 within no less than 3 individual transactions over a period of 6 months.
Furthermore, we will request a banker’s reference as well as two (2) other trade references. Should a credit account be granted, payment will need to be received by Boomerang within 30 days from the date of the invoice. Should payment not be received within 30 days, credit will be automatically withdrawn. Boomerang also makes reservation to exercise its statutory right of Interest Under the Late Payment of Commercial Debts (Interest) Act 1998
Passing of Title and Risk
Risk in the goods shall pass to you upon delivery. It is important that you report any damage or shortfalls within 48 hours of receiving the goods. No responsibility will be accepted by Boomerang after this time.
If you hold a credit account with us, all goods, delivered or not, remain the property of Boomerang until payment has been received in full.
In the event of non-payment for the goods by you, we will, without loss of any rights or remedy, remove from your possession those goods belonging to us in accordance with these conditions and we shall be entitled to enter upon the property where the goods are kept to repossess and remove the same. We reserve the right to charge you for any legal or collection services.
Product(s)
We reserve the right to alter any details or design of illustrated products without notice. Whilst every effort is made to accurately describe the goods in our catalogue or online, no warranty is given and no responsibility will be accepted for descriptive errors and any losses resulting thereof.
Quotations
Orders are accepted in accordance to prices we quote. Prices quoted do not take into account any changes in the law or Government regulations requiring us to increase prices by way of direct taxation, import duties, customs and excise duties or otherwise.
Contracts
Contract prices quoted and served; take into account current costs of production and distribution. In the unlikely event that Boomerang is subject to any cost increases occurring after confirmation or contract acceptance, Boomerang shall be entitled to charge such increases to you.
Prices
Where applicable all prices quoted are subject to V.A.T at the current rate
Delivery
Whilst every effort will be made to deliver on time, any delivery date specified will be an estimate and no liability can be accepted for any loss arising from delay or error in the delivery of the goods.
Limitations of Liabilities
Save in so far as defects in the goods cause death, injury or damage to personal property, our liability for any loss or damage suffered by you in respect of the goods shall be limited to the contract value of the goods.

Customised Items
Any customised, or specially ordered item(s) are non-returnable
Whilst every effort is made to match print colours to your requirements, due to the variety of both materials and material colours used in our products, we are unable to guarantee that this will always be possible. Please contact us to discuss your own personal requirements.
Artwork may be supplied as hard copy in black and white or in the formats as follow; Jpeg, Gif, Bmp, Png & Psd by e-mail, floppy disc or CD.
Where artwork is sent by e-mail, the actual imprint size may vary depending on the limitations of the product being engraved.
If you do not have your own, Boomerang can produce artwork for you, please call on 0870 444 7345 for details. All printed or engraved orders are final. A proof will be issued and must be confirmed before any engraving or printing commences.
Non-Customised Items
If an order is cancelled prior to delivery but after the payment transaction has been made, you will be refunded for the goods only less 30% re-stocking fees.
You must inform us in either writing or electronic mail (including order number) of your desire to cancel within seven working days commencing on the day after the day the goods are delivered to you. You then have a reasonable period of 21 days to return the goods to us.
You must return the goods to us at your cost in an unused and re-saleable condition and we advise you to ensure the goods are adequately insured during any return journey.
Neither delivery costs nor artwork costs are refundable unless an error caused by us is established
Refunds will be made within 30 days starting with the day on which we receive the returned product from you

Samples
Samples will be provided on a Proforma basis and will be refunded (less postage) if returned to Boomerang within 14 days of your receipt. The goods will also need to be returned in an unused and re-saleable condition.
Changes in Quantities
Any changes in quantities will be regarded as a separate contract unless written notification is received before work commences on the original order.
Force Majeure
Boomerang will not be held responsible for failure or delays in the carrying out of our obligations under these terms arising out of any cause outside our reasonable control or by inability to procure materials or articles except at higher prices due to any such cause and in such circumstances we shall be entitled by notice to terminate the contract in whole or in part without incurring any liability whatsoever to you
